Deepankar Tikedar v. State of Chhatisgarh


1. Leave granted.

2. In the present appeal, the judgment of the High Court (High Court of Chhattisgarh at Bilaspur) in CRA No. 1916 of 2023 dated 25/09/2024, has been impugned, whereby conviction of the appellant under S.376(3) of the Indian Penal Code, 1860 (Hereinafter, "IPC") and S.6 of the Protection of Children from Sexual Offences Act, 2012 (Hereinafter, "POCSO Act") was upheld. Sentence of life imprisonment until natural death, as awarded by the Trial Court, was also upheld.

3. The brief facts of the case are that FIR No. 08/2022 dated 04/05/2022 was registered against the appellant for the offences committed under S.375 of the IPC and S.6 of the POCSO Act. After trial, the appellant was convicted under S.376(3) of the IPC and S.6 of the POCSO Act and sentenced to life imprisonment until natural death by the Trial Court in Special Sessions (POCSO) Case No. 29/2022 vide judgement dated 13/07/2023. In appeal before the High Court (Criminal Appeal (CRA) No. 1916 of 2023), the judgment of conviction and order of sentence were upheld.
