1. The petitioner-wife has filed the petition under Section 25 of the Code of Civil Procedure, 1908 before this Court seeking transfer of case bearing Mat. Suit No. 19 of 2024 titled as “Umaid Iqbal vs. Ghazala Tabassum” pending before the 2nd Civil Judge, (Junior Division) at Alipore, South District 24 Parganas, Kolkata, West Bengal to the Court of Civil Judge, Saket Court, South East District, New Delhi.
2. Despite due service of notice, no one has entered appearance on behalf of the sole respondent.
3. Having heard learned counsel for the petitioner and taking into consideration the grounds taken in the transfer petition, we allow the transfer petition and direct the transfer of case bearing Mat. Suit No. 19 of 2024 titled as “Umaid Iqbal vs. Ghazala Tabassum” pending before the 2nd Civil Judge, (Junior Division) at Signature Not Verified D KA ig P ita ILAll y T A sli N gn Die O d N bpyore, South District 24 Parganas, Kolkata, West Bengal to the Date: 2026.03.12 Reason:
Court of Civil Judge, Saket Court, South East District, New Delhi.
4. Let the record of the case be transferred without delay.
5. A copy of this order be sent to the concerned court for compliance.
6. If video conferencing facility is available with the transferee Court, the benefit of the same shall be extended to the parties.
