UPON hearing the counsel the Court made the following

Signature Not Verified 1. The petitioner has suffered conviction by the Trial Digitally signed by MINI Date: 2026.03.13 Reason:

committing offence under Section 138 of Negotiable Instruments Act, 1881 and has been awarded sentence of simple imprisonment for six months. The order of conviction was challenged before this Court in Special Leave Petition (Crl.) No.16995 of 2025 which was dismissed on 05.12.2025.

2. Immediately, after the dismissal of the Special Leave Petition, petitioner and the respondent have entered into a compromise, as is evident in Annexure A-4, wherein the petitioner has paid the amount of Rs.7,50,000/- to the respondent by way of Demand Draft dated 08.12.2025 and the compromise deed was notarized on 09.12.2025.

3. Thereafter, the petitioner has moved this Miscellaneous Application for recording the compromise, and acquitting him of the charges. However, since there was a direction while dismissing the Special Leave Petition that the petitioner shall surrender within 15 days, when this Miscellaneous Application was taken up for consideration, the petitioner was directed to surrender, in obedience of which the petitioner surrendered before the Trial Court on 26.02.2026 and he was released on bail by this Court on

27.02.2026.

4. Learned counsel for the respondent-complainant would submit that she has entered into a compromise and she has received the amount of Rs.7,50,000/-.

5. In view of the above, we allow this Miscellaneous Application and modify our order dated 05.12.2025 in Special Leave Petition (Crl.) No. 16995 of 2025 to the effect that instead of dismissing the Special Leave Petition it shall stand allowed by accepting the compromise entered between the parties and thereby setting aside the impugned judgment of conviction and sentence imposed upon the petitioner.

6. Accordingly, the Miscellaneous Application shall stands allowed.
