UPON hearing the counsel, the Court made the following
O R D E R
Special Leave Petition (Civil) Nos. 21082-21083/2023
1. These special leave petitions arise out of the orders dated 13.04.2023 and 24.03.2023 passed by the High Court of Gujarat at Ahmedabad in R/Special Civil Application No. 3978 of 2023. By the order dated 24.03.2023, the High Court confirmed the order dated 11.05.2022 passed in Regular Civil Suit No. 300 of 2005 by the learned 9th Additional Civil Judge, Mirzapur, Ahmedabad (Rural), whereby the third-party application filed by Sakariben Khodaji Shivaji Thakor was allowed and she was joined as a plaintiff in the said suit. By the later order dated 13.04.2023, the High Court rejected the petition for correction of the order dated 24.03.2023, holding that there was no error therein.
2. The petitioners, four in number, were the applicants before the High Court in R/Special Civil Application No. 3978 of 2023. Thereby, they raised objections to the impleadment of Sakariben Khodaji Shivaji Thakor as a plaintiff in aforestated suit. However, the High Court noted that they had filed Purshis (viz., a statement submitted to a Court by a party or its Advocate to place specific information, facts or requests on record during the proceedings) seeking to withdraw from the said suit and observed that they could have no grievance if Sakariben Khodaji Shivaji Thakor was permitted to come on record as a plaintiff in the suit and continue the proceedings therein against the defendants. We find no error having been committed by the High Court in holding to this effect.
