The Supreme Court can exercise its power under Article 142 of the Constitution of India to dissolve a marriage by mutual consent and dispose of all related pending litigations when parties reach a comprehensive settlement through mediation.

O R D E R

1. The present petition was filed by the petitioner–wife seeking transfer of Divorce Petition bearing Original Suit No. 718/2024 titled as "Varun Bansal vs. Naina Bhatia" filed by the respondent-husband, pending before the Principal Judge, Family Court, Dhanbad, Jharkhand to the Principal Judge, Family Court, Moradabad, Uttar Pradesh.

2. Vide order dated 08.08.2025, the matter was referred to the Supreme Court Mediation Centre.

3. With the efforts made by the learned counsel for the parties, the learned Mediator and the positive approach of the parties, the dispute stands resolved. Settlement agreement has been signed on 22.09.2025. An application (IA No.46308/2026) has been filed before this Court under Article 142 of the Constitution of India for dissolution of marriage by way of mutual consent.

4. There is one child born from the wedlock. Issue regarding his custody has also been settled. It is agreed between the parties, as

mentioned in paragraph D of the settlement agreement, that respondent-husband will neither meet nor claim any right over his son namely Master Yug. The son, Master Yug and petitioner-wife will also not claim any rights over the properties/ancestral properties of his father/family members.

As per the settlement arrived at between the parties, the respondent-husband is to pay a total sum of ₹34,00,000/- to the petitioner-wife as permanent alimony for her past, present and future claims. Out of the aforesaid amount, ₹17,00,000/- has already been paid whereas the balance amount of ₹17,00,000/- has been paid today in Court to the learned counsel for the petitioner-wife by way of a demand draft No.000283 dated 22.01.2026, drawn from HDFC Bank.

6. It is further agreed that the following cases pending between the parties shall stand disposed of as compromised.

“(i) Petitioner/wife has filed Case being Criminal Misc.Case No.187/2022 pending before the CJM, Moradabad, titled as ‘Naina Bhatia vs. Varun Bansal’.

(ii) Petitioner/wife has filed Case being Criminal Misc.Case No.607/2023 pending before the CJM, Moradabad, titled as ‘Naina Bhatia vs. Varun Bansal’.

(iii) Respondent/husband has filed divorce petition being Original Suit/718/2024 at Dhanbad before the Family Court, Dhanbad seeking dissolution of marriage.

(iv) Respondent/husband has filed petition No.CRLR/2169/2024 pending before the Hon’ble High Court at Allahabad.”

7. The petitioner has joined through video conferencing and respondent is present before Court in-person. They have admitted settlement of the dispute.

Considering the aforesaid development and resolution of the dispute between the parties, we allow IA No.46308/2026 filed under Article 142 of the Constitution of India and dissolve the marriage between the parties by way of mutual consent. The parties shall remain bound by the conditions laid down in the settlement agreement. The following cases filed by the parties against each other shall stand disposed of as compromised.

“(i) Petitioner/wife has filed Case being Criminal Misc.Case No.187/2022 pending before the CJM, Moradabad, titled as ‘Naina Bhatia vs. Varun Bansal’.

(ii) Petitioner/wife has filed Case being Criminal Misc.Case No.607/2023 pending before the CJM, Moradabad, titled as ‘Naina Bhatia vs. Varun Bansal’.

(iii) Respondent/husband has filed divorce petition being Original Suit/718/2024 at Dhanbad before the Family Court, Dhanbad seeking dissolution of marriage.
