O R D E R

1. The present Transfer Petitions have been filed seeking transfer of the proceedings with the following prayers:

Transfer Petition (C) Nos. 2095-2097 Of 2025 (i) Transfer CS No. 492 of 2022 titled "Jagdish Kumar vs. Sushma & Ors." being Suit for declaration and other reliefs, pending adjudication before the Court of the Civil Judge (Jr. Division) Gurugram District Courts at Haryana to the High Court of Delhi at New Delhi;

(ii) Transfer CS No. 3558 of 2022 titled "Jagdish Kumar vs. Sushma & Ors." being Suit for declaration and other reliefs, pending adjudication before the Court of the Civil Judge (Jr. Division) Gurugram District Courts at Haryana to the Hon'ble High Court of Delhi at New Delhi;

(iii) Transfer CS No. 1408 of 2023 titled "Jagdish Kumar vs. Sushma & Ors." being Suit for Partition, Declaration and other Signature Not Verified K D A at P e I : L 2 Tr0 A 26 Ne. D 02 Ol.2 N 8iefs, pending adjudication before the Court of the Civil Judge Reason:

(Jr. Division) Gurugram District Courts at Haryana to the Hon'ble High Court of Delhi at New Delhi.

Transfer Petition (C) Nos. 3204-3205 Of 2025 (iv). Transfer CS(OS) No. 172 of 2022 titled "Sushma Rani V. Jagdish Kumar & Ors." pending before the High Court of Delhi at New Delhi to the Court of the District Judge, Gurugram, Haryana;

(v). Transfer CS DJ No. 592 of 2021 titled "Jagdish Kumar v. Sushma Rani & Ors." pending before the Court of the District Judge, Saket Courts (South East Distt.), New Delhi to the Court of the District Judge, Gurugram, Haryana; and

2. Heard the learned counsel for the parties. There are five suits pending inter se the parties which are substantially pertaining to declaration and partition of certain properties in Delhi and Haryana, out of which three proceedings are pending in Gurugram, Haryana and other two are pending in Delhi. In order to avoid multiplicity of the proceedings, we are of the opinion that the suits which have been instituted in Delhi being CS(OS) No. 172 of 2022 and CS DJ No. 592 of 2021 be transferred and heard along with the matters (being CS No. 492 of 2022, CS No. 3558 of 2022 and CS No. 1408 of 2023) pending before the Court of Civil Judge (Jr. Division) Gurugram District Courts at Haryana. Ordered accordingly. 3. Consequently, the Transfer Petition (C) Nos. 2095-2097 Of 2025 are dismissed and the Transfer Petition (C) Nos. 3204-3205 Of 2025 are allowed.

4. Let the records of the case be transferred without delay.

5. A copy of this order be sent to the concerned courts for compliance.

6. If video conferencing facility is available with the transferee Court, the benefit of the same shall be extended to the parties.

7. Before initiation of the proceedings, at the request of the parties, we are inclined to direct that the concerned Court shall refer the matter for mediation to the Court annexed Mediation Centre at Gurugram District Court for an amicable resolution of the disputes.

8. Pending application(s), if any, shall stand disposed of.
