UPON hearing the counsel the Court made the following

O R D E R

1. Read the office report.

2. It appears therefrom that the missing records pertaining to Case Crime Nos.740/2009 and 489/2012 have been traced out only after this Court had Signature Not Verified Digitally signed by JATINdDEiRr KAeURcted re-construction of the missing records. That is indeed a positive Date: 2026.02.26

development, but the fact is that the records were traced only after judicial intervention by this Court.

3. We need to ascertain as to whether the untraceability was attributable to any motivated attempt to obstruct the flow of justice or arose out of genuine human error.

4. We direct the District Judge, Raibareli to enquire into the matter and submit a report before this Court by six weeks.

5. Ms. Pragati Neekhra, learned counsel appearing for the petitioner, points out that in several other cases, the records are missing, namely:

(I) Proceedings arising out of FIR No. 32/2013 u/s-326-A IPC at P.S.

Alam Bagh, Lucknow;

(ii) Proceedings arising out of FIR No. 374/2017 dated 03.07.2017 u/s

326-A IPC at P.S. Unchahar; and (iii) Proceedings arising out of Crime No.126/2017 u/s 326-A IPC & Sec.

3(2)V of SC/ST Act, P.S. GRP Charbagh.

6. The ACJM, Court No.13, Raibareli and Special Judge, SC/ST Act, Raibareli are directed to submit a status report with regard to availability of the alleged missing case files.

7. Such report may be submitted before this Court, through the District Judge, Raibareli within the aforesaid period of six weeks.

8. Needless to observe, Complaint Case No.39/2012 may be placed before the Special Judge, Raibareli Court. The court concerned shall proceed expeditiously to take the same to its logical conclusion.

9. Status report shall be filed in respect of progress of Complaint Case No.39/2012 by six weeks.

10. If the petitioner approaches the District Judge/Special Judge/ACJM, Raibareli for obtaining certified copies relating to the documents forming part of the records of the above cases, the same may be issued to the petitioner without any delay after maintaining formalities.

11. Re-list the transfer petitions after six weeks.
