1. The application for listing the Curative Petition in open Court is rejected.

2. The Curative Petition is defective for the reasons stated in the Office Report. The defects were communicated to the counsel vide this Registry’s letter dated 06.01.2026 but he has not cured the same so far.

3. However, instead of rejecting this petition for non-

prosecution, we have gone through the same on merits.

4. In our opinion, no case to entertain the Curative Petition is made out within the parameters indicated by this Court in the case of Rupa Ashok Hurra vs. Ashok Hurra & Anr., (2002) 4 SCC 388.

5. Hence, the Curative Petition is dismissed.
