1. Heard learned counsel for the parties.

2. Leave granted.

3. By an order dated 29.08.2025, the parties were referred for mediation before the Coordinator of the Supreme Court Mediation Centre.

4. The parties have arrived at a settlement and the Settlement dated 03.12.2025 is placed on record.

5. An application seeking dissolution of marriage dated 28.11.2016 by a decree of divorce on the basis of mutual consent has been filed under Article 142 of the Constitution of India.

6. In the aforesaid facts and circumstances of the case, we consider it appropriate to exercise our discretionary jurisdiction under Article 142 of the Constitution of Signature Not VerifiedIndia.

8. It is needless to observe that the pending litigation between the parties is also either terminated or wound up by the respective courts as has been agreed between the parties.

9. The appeal shall stand disposed of in terms of the Settlement Agreement. The parties shall remain bound by the terms and conditions of the Settlement Agreement.

10. A copy of this order may be conveyed to all the courts where proceedings are pending, for closing the matters.

11. Pending application(s), if any, shall stand disposed of.

SETTLEMENT AGREEMENT This Settlement Agreement is entered into between Petitioner – Mr. Sheshnath Sharma S/o Late Krishna Nand Sharma, R/o Section-II/D, Street-5, QRS No. 1-278, P.O., P.S.-B.S. City Bokaro, Jharkhand (hereinafter referred to as Petitioner-Husband) and Ms. Sunidhi Sharma D/o Mr. Surendra Sharma W/o Sheshnath Sharma R/o Section-II/B, QRS No. 3-127, P.O., P.S.-B.S. City Bokaro, Jharkhand (hereinafter referred to as Respondent/Wife). 1. Whereas the marriage between the petitioner and respondent/wife was solemnized as per Hindu rites and ceremonies on 28.11.2016 at Bokaro, Steel City, Jharkhand. After marriage parties resided together at Bangalore and there is no issue out of wedlock. 2. Both the parties resided together as husband and wife till 02.08.2018, and thereafter disputes and differences arose between the parties and since then Respondent/wife is staying with her parents at Bokaro, Jharkhand. The Petitioner/Husband has filed Original Suit No. 522/2019 before the Family Court at Bokaro seeking dissolution of marriage.

3. Whereas the Parties have filed following cases against each other:-

(i) The Petitioner/Husband has filed Original Suit No. 522/2019 before the Family Court at Bokaro.

(ii) The Respondent/Wife has filed Complaint Case No. 834/2018 under Section 498A IPC r/w Section 3 & 4 of Dowry Prohibition Act, titled as Sunidhi Sharma Vs Sheshnath Sharma and Ors., pending before Ld. CJM, Bokaro-

Jharkhand.

(iii)The Respondent/Wife has filed Original Maintenance Case No. 254/2018 under Section 125 Cr.P.C., titled as Sunidhi Sharma Vs Sheshnath Sharma and Ors., pending before Ld.

Family Court, Bokaro-Jharkhand.

4. Whereas Hon’ble Supreme Court vide Order dated 29.08.2025 in Special Leave Petition (C) No. 23447/2025 has referred the matter to Supreme Court Mediation Centre. Comprehensive mediation sessions were held between the parties and their respective advocates on 04.09.2025, 03.10.2025, 07.10.2025, 10.10.2025 by both physical and virtual mode and finally on 03.12.2025 parties have arrived to settle the dispute.

5. Both the parties hereto have arrived at an amicable settlement on the following terms and conditions for dissolution of marriage by mutual consent:-
