UPON hearing the counsel the Court made the following

O R D E R

1) The petitioner is apprehending his arrest in connection with FIR No. 328 dated 08.07.2025 registered at Police Station Mujessar, District Faridabad, for the offences punishable under Sections 351(2), 3(5), 232(1) of the BNS1 and Section 6 of POCSO Act, Indian Penal Code, 1860 (Sections 376 and

365 IPC3 added later on).

2 The Protection of Children from Sexual Offences Act, 2012

2) While issuing notice on 27.11.2025, by way of interim relief, direction for not taking coercive steps subject to cooperation in the investigation, was issued.

3) After hearing learned counsel for the parties and considering that the petitioner is cooperating in the investigation, in the facts of this case, without expressing any opinion on the merits of the case, we deem it appropriate to confirm the order of interim protection and deem it appropriate to release the petitioner on anticipatory bail.

4) In view of the above, we direct that in the event of arrest, the petitioner shall be released on bail on furnishing suitable bail bonds and sureties and on such other terms and conditions as may be deemed fit by the Station House Officer of the concerned police station.

5) We further direct that the petitioner shall join the investigation as and when required and co-operate in the same abiding all the conditions as specified under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023.

6) It is made clear here that violation, if any, by the petitioner, may give a cause to take recourse as permissible and the trial Court is at liberty to do the needful.

7) Accordingly, and in view of the foregoing, this special leave petition stands disposed of. Pending application(s), if any, shall stand disposed of.
