The present appeal is preferred against the order dated 08.11.2021 which was passed ex-parte by the District Commission, Kohima.
Facts of the case was that the Respondent had taken insurance policy with the appellant bearing policy no. 322202/31/2018/917 effective from 16/10/2017 to midnight
15/10/2018 with Insured’s Declared Value (IDV) of 5,02,133 (Rupees five lakhs two thousand one hundred and thirty-three) for a Mahindra Bolero Single Cab Pickup 4WD bearing registration no. NL/01Q-3018.
Unfortunately, the vehicle was stolen on 05/01/2018 around 8:30 to 9:00 PM from A.G Colony near Chief Engineer Power Office which is untraceable till date. The Complainant filed F.I.R before the South Police Station on 06/01/2019 and registered as GDE No. 9/18.
The Complainant submitted a report of the stolen vehicle to the Petitioner’s branch office at Kohima. Thereafter, on the directions of the appellant the following documents and items were submitted on the directions of the petitioner:
1. To submit the original & duplicate keys
2. To submit all vehicle documents in Original & Insurance policy
3. To submit a quation against the similar nature of vehicle as on the date of loss
