STATE CONSUMER DISPUTES REDRESSAL COMMISSION
Justice S.P.Tavade, P, Vijay C.Premchandani, M
Gokuldham C1 C2 Co-op. Housing Society Ltd. – Appellant
Versus
Mr.Shashikant Vishnu Chavan – Respondent
Misc.Application No.MA/24/153 in A/24/224

Advocates:
For the Appellants/Petitioners: Rajat Bhosale
For the Respondents: Sandip Bhoir

The court ruled that neglect in pursuing an appeal and lack of sufficient cause do not justify condonation of delay under the Consumer Protection Act.

Headnote:(A) Consumer Protection Act, 1986 - Condonation of Delay - Delay of over 5 years in filing an appeal - Application for condonation dismissed due to lack of sufficient cause - Applicant failed to demonstrate diligence in pursuing the appeal and allowed undue delays. (Paras 6, 9)

(B) Legal Precedent - The Supreme Court observed that simple explanations for delay do not meet the requirements for condonation without satisfactory reasons. (Paras 7, 8)

(C) Negligence - The applicant showed negligence and did not act with due diligence to ensure timely filing of the appeal, despite being aware of their duty. (Paras 8, 9)

Facts of the case:
The applicant society filed an application to condone a 5-year delay in appealing against an order by the District Consumer Forum. They attributed the delay to the negligence of their appointed advocate and the Covid-19 pandemic, but the court found these reasons insufficient.

Findings of Court:
The delay in filing the appeal does not meet the standards for condonation and the application was therefore dismissed.

Issues: Whether the applicant provided sufficient cause to justify the delay in appealing the earlier decision.

Ratio Decidendi: The court maintained that sufficient cause must be demonstrated for condonation; simple negligence does not qualify.

Result: Application for condonation of delay dismissed.
