Misc.Application No.MA/24/153 in A/24/224
For the Appellants/Petitioners: Rajat Bhosale
For the Respondents: Sandip Bhoir
A delay in filing an appeal may not be condoned without sufficient cause, and reliance on an advocate does not exempt a party from diligence regarding court proceedings.
Headnote:The applicant sought condonation of delay in filing an appeal against an order by the District Consumer Forum. The delay of over 5 years was primarily attributed to reliance on an advocate's representation, compounded by the Covid-19 pandemic. The court noted the lack of diligence on the part of the applicant, emphasizing that the reasons presented did not meet the threshold for condonation of delay as outlined under the Consumer Protection Act, referencing relevant Supreme Court judgments. The application was ultimately dismissed.
