The instant complaint has been filed by the complainants under section 17(1)(a)(i) of C.P. Act, 1986 against the OPs alleging deficiency in service.
The facts of the case, in a nut shell, are that the complainants entered into an agreement for sale on 02.08.2017 with The OPs for purchasing a flat being No.D-2 on the 3rd floor measuring about 1510 sq. ft. (including 25% super built-up area) and a covered garage measuring about 314 sq. ft. super built-up area at the ground floor at the premises being No.11B, SambhuDasguptaSarani, P.O. Bhadrakali, P.S. Uttarpara, District – Hooghly at a price of Rs.51 lakh only. The price of the flat was fixed at Rs.40,77,000/- and the price of the car parking space was fixed at Rs.10,23,000/-. The original owners of the land namely, Smt. KakoliChakraborty, Dr.ParameshChakraborty, Sri PankajChakraborty, Smt. SuklaChakraborty, Smt. Parama Gupta, Smt. AratiGanguly and Smt. Manju Bhattacharya came into a joint venture agreement inter alia registered development agreement cum general power of attorney on 18.11.15 with the OPs No.1, 2 & 3 being OP No.1 is the Developing Firm represented by its partners being OPs No.2 & 3.
