Headnote:(A) Consumer Protection Act, 2019 - Section 41 - Insurance claim - Appeal against dismissal of complaint for deficiency in service - Life assured failed to disclose pre-existing health conditions - Court finds that the repudiation of claim was unjustified due to lack of evidence of concealment - Medical examination prior to insurance showed no pre-existing ailments. (Paras 1, 10, 11, 13, 14)

(B) Burden of proof - The onus to prove suppression of material facts lies with the insurance company, which failed to provide adequate evidence to support its claims. (Paras 11, 12)

Facts of the case:
Complainant's husband obtained a mortgage loan and associated life insurance; claim was repudiated post his death due to alleged nondisclosure of health issues.

The court concluded that the insurance company's repudiation lacked sufficient evidence and constituted a deficiency in service.

Issues: Whether the life assured concealed pre-existing health conditions and if the insurance company justifiably repudiated the claim.
