1. The appeal is filed by the first opposite party in CC No.19/2022 (herein after called appellant) as against the order passed by the District Consumer Disputes Redressal Commission, Puducherry in CC No.19/2022. The appeal is filed under section 41 r/w.Section 47(1)(a)(iii) and (b) of Consumer Protection Act, 2019 (hereinafter called the Act in short) against the respondent No.1 herein, the complainant in CC No.19/2022 (herein after called as complainant) and against the respondent no.2, the opposite party no.2 in the CC (herein after called as opposite party no.2). Aggrieved by the order of District Commission, the appellant is here before us and praying for the following relief:
(1) To pass an order, setting aside the order dated 29.02.2024 passed by the District Consumer Disputes Redressal Commission, Puducherry in CC No.19 of 2022 in favour of the appellant's/1st opposite party and dismiss the complainant of the respondent/complainant.
(2) To pass an order, awarding cost of present proceedings in favour of the appellant/1st opposite party against the respondent/complainant.
2. The following order has been passed by the District Commission dated 29.02.2024:
i). The Opposite Party no.1 & 2 are directed to refund jointly and severally, an amount of Rs.73,000/- (Rupees Seventy three thousand only) being the cost of the vehicle as per Ex.C3 invoice.
ii). The Opposite Party no. 1 & 2 are directed to pay jointly and severally an amount of Rs.20,000/- (Rupees Twenty thousand only) towards compensation for the mental agony, physical hardships and other suffering sustained by the Complainant due to the deficiency in service.
iii). The Opposite Parties no.1 & 2 are directed to pay jointly and severally an amount of Rs.3,000/- (Rupees Three thousand only) towards litigation costs.
iv). The Opposite Parties no. 1 & 2 are directed to comply the orders passed herewith and also directed to pay the above mentioned amounts to the complainant, within 30 days of the receipt of the copy of the order.
v). The Complainant is directed to handover the vehicle purchased as per Ex.C3 invoice dated 06.01.2022 to the Opposite Party no.1 on proper acknowledgement within one month of the receipt of the copy of the order.
