By this order of ours, two Appeals i.e. F.A. No.447 of 2021 titled as “Major Mrs. Mary Kutty (Now Ret. Lt. Col.) Vs. M/s Bhagat Ford & another” and F.A. No.449 of 2021 titled as “M/s A.B. Motors Pvt. Ltd. & another Vs. Major Mrs. Marry Kutty” shall be disposed off as the said Appeals have been filed under Section 41 of the Consumer Protection Act, 2019 (in short the ‘Act’) being aggrieved by the order dated 29.10.2021 passed by the District Consumer Disputes Redressal Commission, Amritsar (in short the ‘District Commission’) in C.C. No.817 of 2005.
2. F.A. No.449 of 2021 titled as “M/s A.B. Motors Pvt. Ltd. & another Vs. Major Mrs. Marry Kutty” has been filed by the Appellants/OPs for setting aside the impugned order dated 29.10.2021 passed by the District Commission.
3. Common questions of facts and law are involved in both the Appeals. F.A. No.447 of 2021 titled as “Major Mrs. Mary Kutty (Now Ret. Lt. Col.) Vs. M/s Bhagat Ford & another” has been filed by the Appellant/Complainant for modification of order dated 29.10.2021 passed by the District Commission by granting interest and enhancing amount of compensation and litigation cost.
