JUDGMENT

Per Sri Sushil Kumar, Acting President:- This appeal has been directed against the judgment and order dated 3.2.2024 passed by the Ld. District Commission, Aligarh in complaint case no.76 of 2023, Mrs. Archana Bhargava vs. Reliance Jio Infocomm Ltd. & ors., whereby the ld. District Commission allowed the complaint and directed the opposite parties to reimburse jointly and severally the amount Rs.10,04,000.00 with interest @9% per annum from 28.11.2022 alongwith Rs.25,000.00 as compensation and Rs.20,000.00 as litigation expenses.

We have heard the ld. counsel for the parties and gone through the record.

The complainant in her complaint has stated that she is the proprietor of the authorized Maruti Service Station of the firm M/s Kapil Automobiles at Sarai Rahman G.T. Road, Aligarh and her son Mr. Sanchit Bhargav is the C.E.O. of the firm. The firm has its CC account in the opposite party Bank Main Branch, Masoodabad, Aligarh and the account no. 05830500008386 is maintained there with registered mobile no. 9837007636 and email sanchit@kapilautomoblies.co Id is registered therein. On 26.11.2022 at 18.16 o’clock a text message was received on the said mobile number to the effect that the mobile number had been temporarily stopped. On this, the son of the complainant made a complaint on toll free no. 199 of the op JIO company and thereafter at 19.52 o’clock the mobile number started to operate. Again on 27.11.2022 at 18.33 o’clock the same message was received on said mobile number and when the complaint was made on toll free no.199 of OP JIO Company then as per link https://www.jio.com/getmyjio given in the message details were sent and thereafter mobile again started to update at 19.36 o’clock. On 28.11.2022 complainant’s son received two messages of net banking login of the opposite party bank on the said mobile number whereas no net banking login was operated by the complainant. The complainant’s son contacted Mr. Muyur Bharti at his mobile number 9760422546 in the opposite party bank branch who checked the account and informed that two transactions of the amount Rs.5,00,000.00 and Rs.5,04,000.00 were operated through RTGS. When the complainant’s son told Mr. Bharti that no transaction was operated by him then the bank account was frozen by the bank. The complainant has further stated that the net banking facility is provided by the bank and is operated through the technological system maintained by the opposite party JIО Company and is responsible for providing the risk free safe system to use the facility of net banking provided by the
