Versus
Oriental Insurance Co. Ltd – Respondent
FIRST APPEAL NO. SC/9/A/911/2023 | APPEAL NO. 750/2023 | APPEAL NO. 911/2023 | CONSUMER COMPLAINT NO. 156/2012
For the Appellants/Petitioners: Munna Dail System, Anil Kumar Mishra
For the Respondents: Oriental Insurance Co. Ltd, Rehana Khan, Saket Srivastava
In insurance disputes, a surveyor's report holds significant evidentiary value. The burden of proof lies with the claimant to substantiate the actual financial loss through consistent documentation. Appellate courts will intervene when lower forums fail to objectively verify damages against provided financial evidence like tax returns.
Headnote:(A) Consumer Protection - Insurance Claim - Burden of proof - Settlement of claim - Assessment of loss - It is a settled legal principle that while surveyor reports are not binding, they hold evidentiary value unless refuted by independent and credible evidence - An insured party must prove the actual loss sustained - Mere assertions are insufficient when documentation is inconsistent or contradictory. (Paras 14, 15, 16)
(B) Appeal - Scope - Appellate courts should verify if the decision below is grounded in material evidence or if it deviates from established directions for remand, particularly regarding the comparison of purchase invoices with tax returns to determine actual stock loss. (Para 10)
Facts of the case:
The claimant operated a business covered under an insurance policy for stock and furniture. Following an alleged theft, a claim was filed, which was contested by the insurer on grounds of inconsistent reporting of the quantity of stolen items, lack of cooperation with the surveyor, and improper documentation. The initial award by the lower commission was challenged by both parties—the insurer seeking to set aside the order and the claimant seeking increased compensation.
Findings of Court:
The court noted that the claimant inconsistently reported the number of stolen items, ranging from 13 initially to 150 at the time of survey, and eventually to 351. The court found that the claimant failed to provide reliable evidence to support the higher quantum of loss despite specific instructions during a prior remand to conduct a comparative study of purchase invoices and tax returns. Consequently, the court restricted the compensation to the amount assessed by the surveyor.
Issues: The primary issues were the validity of the quantity of items claimed as stolen and the evidentiary value of the surveyor’s assessment versus the claimant’s assertions in the absence of corroborative financial documentation.
Ratio Decidendi: The burden of proof rests upon the consumer to establish the precise quantum of loss. When a claimant repeatedly changes their stand regarding the quantity of stolen goods and fails to provide consistent supporting financial documentation as directed, the estimation provided by the surveyor, being the only verified evidence, must be upheld.
Result: Appeals partially allowed; order modified to award original assessed amount with interest.
