JUDGEMENT

SRI. AJITH KUMAR D. : JUDICIAL MEMBER The opposite parties in C.C.No.171/2022 on the files of the District Consumer Disputes Redressal Commission, Palakkad (the District Commission for short) are the appellants.

2. The complainant had approached the District Commission on an allegation that st she was offered admission for M.Sc. Biochemistry in the 1 opposite party’s institution under the management quota. The complainant had submitted her degree certificate before the interview board. They verified all certificates and informed that the complainant is eligible for admission to M.Sc. Biochemistry and directed the complainant to remit the fees. She remitted Rs.5,000/-(Rupees Five Thousand only) towards registration and got admission. She had remitted a total sum of Rs.1,36,980/-(Rupees One Lakh Thirty Six Thousand Nine Hundred and Eighty only) towards admission fees, tuition fees and other fees.

2. The Administrator of the 1 opposite party informed the complainant just before the first semester examination that they cannot issue hall ticket and allot registration number for M.Sc. Biochemistry for want of the eligibility criterion fixed by the M.G. University.

The complainant would allege deficiency in service against the opposite parties and hence sought a direction to refund Rs.1,36,980/-(Rupees One Lakh Thirty Six Thousand Nine Hundred and Eighty only) along with interest @12%.

Compensation to the tune of Rs.2,00,000/-(Rupees Two Lakhs only) was also sought for.

4. The opposite parties entered appearance and filed written version by conceding the fact that the complainant got admission in their institution for M.Sc. Biochemistry course. At the time of admission, the college intimated the complainant to cause production of the eligibility certificate from the M.G. University for completing the admission procedure. The complainant had applied for equivalency certificate. The M.G. University informed the complainant that no equivalency certificate is required and instructed her to apply for eligibility certificate. She applied for eligibility certificate and obtained the same on 12.07.2022. By that time, the complainant had failed to cause production of the eligibility certificate. So the permanent register number was not allotted to the complainant.
