STATE CONSUMER DISPUTES REDRESSAL COMMISSION
Smt. Meena Ramanathan, I/c PRESIDENT, Sri. V.V.Seshubabu, MEMBER – (JUDICIAL)
State Bank of India – Appellant
Versus
Bochkar Mohan – Respondent
F.A.No. 484 OF 2024
For the Appellants/Opposite Parties: M/s.Ch.Goverdhan Rao
For the Respondent/Complainant: Party-in-Person
Bank liability for unauthorized transactions upheld, despite consumer reporting delays, based on consumer protection principles.
Headnote:(A) Consumer Protection Act, 2019 - Section 41(1) - Appeal against the order of the District Consumer Commission regarding unauthorized withdrawals from a bank account - Appellants directed to refund the full amount claimed by the Complainant along with interest and compensation - Issues included whether the bank's actions constituted deficiency of service and improper denial of liability under the zero liability framework. (Paras 1, 11)
(B) Essential service standards and circulars - The court held that negligence in reporting unauthorized transactions by the customer does not exempt the bank’s liability where malfeasance occurred and mandated timely communication to the bank as stipulated in the Reserve Bank of India's circular. (Paras 9, 10)
Facts of the case:
Unauthorized transactions from the complainant’s bank account were reported after the requisite period stated in bank regulations, leading to a partial reimbursement. The Complainant sought full recovery claiming bank's liability under a specific circular.
Findings of Court:
The Commission found the bank liable for full reimbursement due to incorrect application of timelines and service standard circulars.
Issues: The key issues were whether the denial of the remaining amount indicated a lack of adequate service and if the timelines communicated by the bank were justified.
Ratio Decidendi: The court reasoned that the Bank's failure to act on the complainant's claims promptly vindicated the complainant's entitlement to recover the funds and reaffirmed consumer protection principles.
Result: Appeal dismissed, affirming the previous order granting relief to the complainant.
