1. The instant appeal has been filed by the appellants to assail the impugned judgment and order dated 26-08-2014 passed by the District Consumer Commission Second, Lucknow in Complaint Case No. 805 of 2011; Gaurav Shukla Vs Canara Bank & Anr.
2. The brief facts giving rise to the instant appeal are that the complainant is an auction purchaser who contacted the opposite parties for purchasing a House/Flat No. 555 J/68 A/2. In this process, the complainant deposited Rs. 2,01,600/- on 05-11-2008 as advance payment and also deposited Rs. 31,090/- at the time of opening of bid. The complainant was directed to deposit remaining amount Rs. 1,50,350/- within 15 days.
3. It is the case of the complainant that he enquired from the opposite parties about the confirmation of sale which was not responded by the opposite parties. The complainant met with the opposite party and on 30-03-2009 he prayed for the refund of an amount of Rs. 51,250/- which was again not heed to by the opposite parties.
