PNB METLIFE INSURANCE CO LTD. – Appellant
Versus
SMT GITA DEVI – Respondent
FIRST APPEAL NO. SC/10/FA/144/2025 | SC/10/IA/48/2025 | SC/10/IA/47/2025
For the Appellants/Petitioners: Adv. Anil Kr.
For the Respondents: NEMO
The burden of proof lies on the insurance company to substantiate claim repudiation due to non-disclosure of pre-existing diseases.
Headnote:The appeal sought to set aside the District Consumer Commission's decision mandating the appellant to pay substantial compensation due to claim repudiation. Key facts included a life policy's early claim rejection based on non-disclosure of pre-existing conditions. The Court found the appellant failed to provide credible evidence supporting the repudiation. The primary issue was whether the claimant's concealment justified claim denial. The Court ruled against the appellant, affirming the prior decision.
