Insurers are not liable to refund premiums if the insured fails to comply with policy conditions regarding the declaration of transit consignments.

Headnote:This appeal was filed under Section 15 of the Consumer Protection Act, 1986 contesting a District Commission's ruling that dismissed the complaint due to non-compliance with policy terms and insufficient evidence of prior intimations. The court found that the insurer was justified in denying the claim due to the appellant's breach of mandatory policy conditions. The main issues revolved around the insurer's obligation to guarantee coverage and the appellant's failure to declare consignments leading to the insurer's repudiation of the claim. The appeal concluded with the court affirming the existing ruling of the District Commission.
