Samiksha Bhattacharya, Member The instant complaint has been filed by the complainants under section 17 (1) (a) (i) of C.P. Act, 1986 against the OPs alleging deficiency in service.
Facts of the case, in a nut shell, are that the complainants entered into a tri-partite into an Agreement for Sale with the OPs being the OPs no.1 as developing firm, represented by its sole Proprietor, Mrs. Pratima Bagchi and OP No.2 is the Constituted Attorney Holder of the Landowners on 18.11.2025 to purchase a flat being No.2A, Tower B, Patha Sarathi apart ments situated at B. T. Road, Kolkata – 700002 on the 2nd floor of Block-B admeasuring 1019 sq. ft. (approx.) super built up area and one car parking space admeasuring 134.05 sq. ft. for a total consideration of Rs.51,37,400/- on 18.11.2015. The complainants booked the flat on payment of a booking amount of Rs.1,00,000/- on 19.10.2015 upon assurance of the OPs that the project would be completed as per sanctioned plan no.2014010042 dated 08.07.2014 sanctioned by KMC and to be completed by or before 30.01.2017. The consideration of the flat was Rs.46,87,400/- @ Rs.4,600/- per sq. ft. and the consideration of the parking space was Rs.4,50,000/-.
