Present appeal is preferred against the order dated 04.01.2023 of learned District Consumer Disputes Redressal Commission Kangra at Dharamshala, passed in Consumer Complaint No.146/2022, titled Sanjeev Kapoor Versus Bain Chand Katoch, whereby the complaint filed by the complainant was allowed and the opposite party was directed to refund/pay amount of Rs.2,02,607/- to the complainant alongwith interest @9% per annum from the date of complaint, till realization. The opposite party was also directed to pay Rs.25,000/- as compensation and Rs.7,500/- as costs of litigation.

2. Brief facts of the case are that deceased complainant Shri Sanjeev Kapoor, entered into an oral agreement with the opposite party for construction of his house in March 2019. The total cost of construction as per the opposite party was Rs.11,00,000/-.
