ORDER
Mr. K. Kalita, learned counsel, for the review applicant is present.
This review application is filed against the judgment and order passed by this Commission in FA 11/2020 on 19-09-2024 whereby this Commission upheld the judgment and order dated 19-12-2019 passed by the learnd District Consumer Disputes Redressal Commission (DCDRC) at Morigaon in CP Case No. 6/2017. The learned counsel for the review applicant has referred to Para 23 of the judgment which is reproduced here in below:
“As discussed above, it is clear that though the opposite party received the cheque for Rs. 45,000/- from the petitioner for supply of materials to Kayajan ME School but did not supply the material which we found from the evidence of PW 1 and 2 and for his wrongful act, the complainant suffered the loss and as he was acting on behalf of the principal Mridul Kumar Sarma as such being an agent the opposite party is personally liable to the complainant.”
