O R D E R :-

The instant appeals are arising out of the common order dated 21.03.2023 passed by the District Forum, Kangra at Dharamshala, H.P. in consumer complaint No.277/2022 titled Hritik Gupta vs. HDFC Bank Ltd.

Brief facts of the Case

Briefly, case of the complainant is that in the month of September, 2021 complainant applied for obtaining the “Easy Shop Platinum Preferred Debit Card” to opposite party/HDFC bank but opposite party/HDFC Bank issued “Easy Shop Platinum Debit Card” to the complainant. was repeated by the HDFC Bank Ltd. twice which has caused mental as well as physical agony to the complainant. The complainant applied for obtaining “Easy Shop Platinum Preferred Debit Card” which was to be issued free of cost whereas “Easy Shop Platinum Debit Card” was having annual fee of Rs.750/- plus GST. Despite of request to issue free of cost “Easy Shop Platinum Preferred Debit Card”, the opposite party/HDFC bank issued different and chargeable “Easy Shop Platinum Debit Card” to the complainant. On 03.11.2021 after almost two months, the complainant received the correct “Easy Shop Platinum Preferred Debit Card” through post for which complainant had applied on 10.09.2021.

Further in the months of January/February, 2021 and June, 2021 the complainant made a request for enhancement of existing credit limit on his HDFC Bank Jet Privilege Credit Card from Rs.30,000/- to Rs.56,000/- but opposite party/HDFC bank took approximately six months time for the same. In the month of September 2021, the opposite party/HDFC bank did not enter correct nomination details in the complainant’s locker and savings account despite providing Adhar Card as identity and address proof. There is deficiency in service on the part of the opposite party/HDFC Bank. Hence, the present complaint.

4. The complaint was contested by the opposite party/HDFC bank by filing reply. It is submitted that “Easy Shop Platinum Debit Card” provides facilities as par with “Easy Shop Platinum Preferred Debit Card” as required by the complainant. The “Easy Shop Platinum Preferred Debit Card” could not be issued to the complainant at the relevant time because of malfunctioning in the card code of “Easy Shop Platinum Preferred Debit Card”. The RBI had issued guidelines/notifications to all the banks not to issue Master Cards and since the “Easy Shop Platinum Preferred Debit Card” was on the
