The Appellant/Opposite Party i.e. Interglobe Aviation Limited (wrongly mentioned as ‘Indigo Airlines’ in the Complaint by the Complainant) has filed the present Appeal under Section 41 of the Consumer Protection Act, 2019 (in short the ‘Act’) being aggrieved by the order dated 19.07.2022 passed by the District Consumer Disputes Redressal Commission, Hoshiarpur (hereinafter referred as the ‘District Commission’) in C.C. No.73 of
2020 whereby the Complaint had been partly accepted.
2. Briefly, the facts of the case of the Complainant Dushyant Ohri as made out by him before the District Commission are that the Complainant was a practicing Advocate at Civil Courts, Hoshiarpur. He booked the flight of OPs No.1 and 2 through OP No.3 from Chandigarh to Goa and for return from Goa to Chandigarh for four persons i.e. Complainant Dushyant Ohri himself and three family members. He had paid an amount of Rs.36,036/-. The flight from Chandigarh to Goa was booked for 24.03.2018 vide booking ID NF72997128011388 in Flight No.6E455 and in Flight No.6E687 from Delhi to Goa. The return booking was for 29.03.2018 in flight No.6E5532/545 from Goa to Chandigarh. Further it was mentioned that after some days of the booking, the Complainant had received a message from OPs No.1 and 2 that the return ticket had been re- scheduled and now the re-scheduled flight would be from Goa to Hyderabad on 29.03.2018 in flight No.6E744 at 7.35 am and it would reach Hyderabad at 8.55 am and from Hyderabad to Chandigarh the flight number would be 6E-269 at 11.10 am and it was to reach at Chandigarh at 1.40 pm. The Complainant and his family members took the flight from Chandigarh to Delhi and then from Delhi to Goa on 24.03.2018. The Complainant and his family members were ready to go to Airport but a call was received from the mobile stating that the flight from Goa to Hyderabad had been cancelled and they had to get the flight from Goa to Bengaluru at 7.35 am. Accordingly, the Complainant reached at Goa Airport and the person, who made call to the Complainant met there, had informed the Complainant that his name was Manu. It was disclosed by him that the flight had been rescheduled and the Complainant and his family members had to go from Goa to Bengaluru and from Bengaluru to Delhi and thereafter Delhi to Chandigarh.
