JUSTICE DAYA CHAUDHARY, PRESIDENT Appellants/OPs have filed the present Appeal under Section

41 of the Consumer Protection Act, 2019 being aggrieved by the order dated 18.04.2022 passed by the District Consumer Disputes Redressal Commission, Jalandhar (in short, “the District Commission”), whereby the Complaint filed by the Respondents/ Complainants had been partly allowed by issuing directions to the Appellants/OPs to refund the price of the Air tickets i.e. 16,195/- along with interest at the rate of 9% per ₹

annum from the date of payment till its realization and also to pay an amount of 10,000/- towards compensation and 5,000/- towards ₹ ₹

litigation expenses.

2. It would be apposite to mention here that hereinafter the parties will be referred, as had been arrayed before the District Commission.

Briefly, the facts of the case as made out by the Respondents/Complainants in the Complaint filed by them before the District Commission are that they had planned a trip to Patna Sahib (Bihar) along with their family members and had booked 5 Air tickets with different numbers in Flight No.6E 415. The tickets were confirmed electronically by the Auto Mailing System of the OPs. An amount of

16,195 was paid for purchasing the air tickets. The Complainants had ₹

reached Delhi Airport on 16.03.2018 at 13.00 hours by using the services of Airport Metro. Further, it was mentioned that they remained seated in front of the TV Screen but there was no indication about the status of the flight. Thereafter, all of a sudden, the Complainants had noticed the display board was indicating the boarding of said flight and they had rushed to the Boarding Counter to board the flight. However, they were shocked to know that the boarding had already been closed. The Complainants had approached the staff of the Airlines, who had asked them to deposit an amount of 19,410/- for the next flight from ₹

Delhi to Patna at 6.35 in the next morning. Further, it was mentioned that the Complainants were not in a position to pay such amount, as they had already made the arrange
