No.168/2022 is filed by the Appellant/Opposite Party No.2, U/s 41 of Consumer Protection Act, 2019, praying this Commission to (i) to set aside the exparte Docket Orders, dated 24.03.2022 in C.C.No.605/2021 on the file of the District Consumer Commission-II, Hyderabad; (ii) to pass orders directing the DCC-II, Hyderabad to receive the Written Version, Evidence Affidavit and also Written Arguments of the Appellant herein and (iii) to order further order or orders that are deemed fit and necessary under the circumstances of the case.

2. In view of the dismissal of delay petition vide R.P.IA No.1454/2022, this Revision Petition is rejected.

1. This Interlocutory Application, vide R.P.IA No.1454/2022 in R.P. No.168/2022 is filed by the Petitioner/Opposite Party No.2 U/s 41 of Consumer Protection Act, 2019, R/w Section 151 of C.P.C., for condoning the delay of 78 days in filing the Revision Petition.

2. The Petitioner/Opposite Party No.2 in his given affidavit submitted that the Petitioner/Opposite Party No.2 received Notice in the main C.C.605/2021 on the file of District Consumer Disputes Redressal Commission-II, Hyderabad on 24.11.2021. The Petitioner/Opposite Party No.2 instructed their counsel to appear and file the Vakalath. The said Vakalath was filed on 24.12.2021. A draft written version was sent by the counsel for the approval & signature and the same was processed and returned to the counsel for filing before the Commission. There was a delay in transit of the same. In the meanwhile, the prescribed 45 days were over and the Hon’ble District Commission-II, Hyderabad was pleased to set petitioner/Opposite Party No.2 exparte on 24.03.2022.
