STATE CONSUMER DISPUTES REDRESSAL COMMISSION
Surendra Kumar Jain, President, Shailendra Bhatt, Member
Mahendra Kumar Agarwal – Appellant
Versus
Nilesh Kumar Jain – Respondent
6/2015

Advocates:
For the Appellants/Petitioners: Mahendra Kumar Agarwal, Jameel Ahmed
For the Respondents: Nilesh Kumar Jain, Chandra Prakash Rathore, Shrinath Gupta

Medical services rendered free of charge in government hospitals do not fall within the definition of 'service' under the Consumer Protection Act, 1986. Consequently, patients receiving such treatment are not consumers, and practitioners cannot be held liable under the Act in the absence of consideration.

Headnote:(A) Consumer Protection Act, 1986 - Section 2(1)(o) - Medical Negligence - Definition of 'Service' - Whether free medical service at a government institution falls under the ambit of 'service' - Held, service rendered free of charge at a government hospital does not constitute 'service' as defined under the Act; recipient is not a 'consumer' - Medical practitioner not liable for alleged negligence in the absence of consideration or contractual obligation - Mere failure of a medical procedure does not establish professional negligence - Requirement of robust evidence to prove deficiency of service - Burden of proof lies on the complainant to establish specific acts of negligence rather than mere assumption of guilt arising from adverse patient outcomes. (Paras 8, 9, 12, 13, 16, 17, 18, 19)

Facts of the case:
The complainants approached the commission alleging medical negligence by doctors during a surgical procedure at a government medical facility. It was contended that the operation was left incomplete due to a power outage, resulting in complications and the subsequent death of the patient. The complainants sought compensation for medical expenses, loss of income, and mental distress.

Findings of Court:
The court observed that the procedure was performed free of charge at a government facility. Based on precedent, services rendered without consideration in a government setup fall outside the definition of 'service'. Furthermore, even if the service were covered, there was no evidence of negligence; the medical records indicated that the procedure was suspended due to unforeseen technical difficulties (power failure), and standard protocols were followed to stabilize the patient before transfer.

Issues: Whether a patient treated free of charge at a government hospital is a 'consumer' under the Act and whether the suspension of a surgical procedure due to power failure constitutes medical negligence.

Ratio Decidendi: Service rendered at a government hospital where no charges are levied is not a 'service' under the Act; therefore, the complainants had no locus standi. Moreover, negligence requires proof beyond mere unfortunate outcomes or procedural failures, and in the absence of evidence of breach of duty, a practitioner cannot be held liable.

Result: Complaint dismissed.
