Sh. Vaibhav Jain, learned counsel for the complainants and Sh. Suresh Gautam, learned counsel for opposite party Nos. 1 & 2, are present.  None is present on behalf of opposite party No. 3, although service of notice upon opposite party No. 3 has already been held to be sufficient by way of refusal.

An application has been moved on behalf of the complainants to withdraw this consumer complaint, with permission to file fresh consumer complaint before the District Commission having jurisdiction to entertain and decide the same.

Learned counsel for opposite party Nos. 1 & 2 states that he has no objection, if the aforesaid application is allowed.

Accordingly, the application is allowed.  The consumer complaint is dismissed as withdrawn, with liberty to the complainants to file fresh consumer complaint before the District Commission having jurisdiction in the matter.

Let the record be consigned.
