01). The complaint is filed u/s.17(1)(a)) of the Cons.

Sumer Protection Act,1986 seeking direction to the opposite parties & 2 to refund Rs.34,91,848/- with interest@ 18 % p.a. from 19.7.2016 till the date of realization; to pay compensation of Rs.3 lakhs for inconvenience, hardship and mental agony; and to pay costs of Rs.1,00,000/

The opposite party no.3 is impleaded as per the orders in I.A.No.137/2021 dt.26.7.2021.

The brief averments of the complaint are that the complainant is working as Vice President in M/s.Laurus Labs at Hyderabad, drawing gross salary of Rs.60,06,000/-; that the opposite party no.l - manufacturer of Mercedes Benz cars and opposite party no.2 is the authorized dealer of opposite party no.1; that through the employer, the complainant obtained quotation dt.8.7.2016 from opposite party no.2 for purchase of Standard Ex Series W156, Model GLA Sports, Diesel car for a sum of Rs.34,57,275/- inclusive of life tax, insurance, handling accessories etc.; that on-road price was mentioned as Rs.41,03,761/-; that on behalf of the complainant his employer placed the order on 14.7.2016; that the opposite party no.3 specifically mentioned in the purchase order to provide navigation chip apart from other accessories with 3 years warranty; that on 19.7.2016 the opposite party sold the said car for a net price of Rs.34,91,848.76; that the employer granted a loan of Rs.34,34,550/- to the complainant for the purchase of the said car; that on 18.7.2016 the employer sent a mail to the complainant that the complainant has to pay Rs.3,53,761/, accordingly it was transferred on 19.7.2016; that the complainant has to discharge the loan of the employer at Rs.8 lakhs per annum out of his perks and due to the same gross salary of the complainant was re-structured and revised from Rs.60,06,000/-

Rs.56,36,544/-p.a.; that one Ms.Anitha Raghavan and Maheswari of the opposite party no.2 brought a box containing SD Card Chip Set for navigation, but the attempt was not successful,; that they further informed to the complainant that there was no provision to install SD Card Chip, but in the couple of days they would do so; that when there was no response from the opposite party for about one week, the complainant made a phone call for which the opposite party no.2 replied that the SD Chip Card was not received from opposite party no.1 and immediately after receiving the same it would be installed within two hours; that even after expiry of one month there was no response from opposite party no.2, as such the car was taken to

the show room of opposite party no.2 and again the technical staff informed that they were in contact with opposite party no.l and the moment they receive the information, would install the Chip;
