The Appellant/Complainant has filed the present Appeal under Section 41 of the Consumer Protection Act, 2019, (in short the ‘Act’) for setting aside the order dated 05.09.2022 of the District Consumer Disputes Redressal Commission, Hoshiarpur whereby the Complaint filed by the Complainant had been disposed off.
2. It would be apposite to mention that hereinafter the parties will be referred, as were arrayed before the District Commission.
3. Briefly, the facts of the case as made out in the Complaint before the District Commission are that the Complainant had planned to construct a house on her plot in the month of January 2019. She accompanied by her husband had visited the shop of OP No.1 to purchase Sagwaan woods for door and window chaugaths for her house. They met Mr.Manish Singla and after seeing Sagwaan and other various types of natural wood, Mr.Manish Singla had shown them the WPC frames of ‘SV woods’ Brand (Chugaths). He had convinced them to buy the same instead of natural wood. He had informed them that WPC frames had certain qualities like maximum load bearing capacity, high strength, termite proof, smooth surface, ecofriendly, longevity, paintable and polishable, water proof, non- shrinkable and non-expandable. After being convinced by the benefits of WPC frames, she had planned to buy the same. She had purchased WPC door and window frames (SV Woods Brand) totaling 708 running feet costing Rs.1,81,491/- vide invoice No.15576 dated 09.02.2019 and 16927 dated 11.03.2019 respectively. They were installed as per the instructions of OP No. 1. Thereafter in May, 2019, she noticed that two of the door frames had started bending. She brought the defect to the notice of OP No.1 and showed the photographs of the bent frames to Mr. Manish Singla. He told that they would take up the matter with manufacturer i.e. OP No. 2. An agent of OP No.1 alongwith Mr.Sanjeev of OP No.2 had visited the site in the presence of the Complainant. They found the complaint was genuine. Thereafter, she again visited the office of the OPs in the first week of June, 2019 to enquire about the progress of her complaint. But OPs had sought some more time to look into the matter. In the month of June, 2019, two other WPC frames had also started bending. The same was brought to the notice of OP No.1, OP No.1 again told to contact the manufacturer directly i.e. OP No.2.
