JUSTICE RAJ SHEKHAR ATTRI, PRESIDENT As per the facts narrated by the complainant, he purchased a Jeep Compass Model S, bearing Chassis No. MCANJPEH2NFA92743*4N and Engine No. 2910863, through invoice no. WSLCHD-22-23-

043 dated 11.05.2022 (Annexure C-1) from the opposite party no.2, after paying Rs.6,05,597/- as down payment and availing a car loan of Rs.22,00,000/- at 7.35% interest per annum (Annexure C-2). However, from the very beginning, the complainant faced multiple defects and performance issues with the car, compelling repeated visits to opposite party no.3, the authorized service centre. Initially, the Left-Hand Side Seat Belt Sensor emitted continuous beeping despite the seat being unoccupied, which required four separate visits before it was replaced under warranty on 15.07.2022 (Annexure C-3). Despite this, the car continued to give problems, leading the complainant to send a detailed email dated 03.11.2022 (Annexure C-4) outlining persistent defects such as the U-connect screen turning blue in reverse gear, engine noise due to AC pipe contact, and malfunctioning memory seat settings. Upon inspection, opposite party no.3 replaced the faulty pig-tail wiring, adjusted the AC pipe, recalibrated the memory seat, and adjusted the driver’s side door, as shown in invoice dated 24.11.2022 (Annexure C-5). Further issues continued, including the U- connect screen being stuck at maximum brightness, ineffective air recirculation, and poor fuel efficiency. On 13.09.2023, the R.H.S. Front Seat Trim was replaced under warranty (Annexure C-6). Subsequently, on 25.12.2023, the car failed to start and was towed by Roadside Assistance (RSA) to opposite party no.3, where the service team replaced all four spark plugs at a cost of Rs.7,775/- (Annexure C-7), despite the car being under warranty. Even after this, the car again failed to start on 09.02.2024, leading to another RSA intervention (Ref. No. X124079641IND). The repeated defects and breakdowns clearly indicate inherent manufacturing defects in the said vehicle. Moreover, the warranty conditions provided by opposite party no.1 are arbitrary, one-sided, and unfair within the meaning of Section 47(1)(a)(ii) of the Consumer Protection
