1. This is an appeal challenging the correctness and legality of the judgment and order passed by the Ld. District Consumer Disputes Redressal Commission Solapur (‘District Commission’ for short) in Consumer Complaint No.CC/430 /2016. In the said case, the District Commission has partly allowed the complaint. Being aggrieved by the order passed by the District Consumer Disputes Redressal Commission Solapur, Appellant filed an appeal with Delay condonation application.
2. Adv. Sandeep S. Jinsiwale for Appellant is appeared. No one appeared for Respondent. As per order dated 09/09/2025, last chance was given to the Respondent to appear before this commission and argued the same, but he did not appear therefore, today we heard Appellant on delay condonation application.
3. The Applicant submitted that, that there is delay of 159 days overfilling this present Appeal against the Respondent.
4. The Applicants/Appellants submitted that, the Hon'ble District Commission was pleased to pass the aforesaid order on 04/10/2018.The Applicants/Appellants submit that Mohol office is the concerned office. The Applicants/Appellants submit that the Advocate for the Appellant collected the said copy on 19/10/2018 and forwarded the same to the Appellants on
25/10/2018 along with letter dated 23/10/2018.
5. The Applicants/Appellants submitted that thereafter the Appellants forwarded the matter to the Assistant Law Officer at Solapur. The Applicants/Appellants submit that the Assistant Law Officer forwarded the papers to the Legal Advisor. Pune Zone, Pune by his letter dated 16/11/2018. Applicants/Appellants submit that the office of the Legal Advisor, Pune by letter dated 26/11/2018 given the legal opinion. Thereafter the said opinion was intimated to Mohol Division. The Applicant/Appellants submits that thereafter the Papers were forwarded to the Chief Legal Advisor to file the Appeal.
6. The Applicant/Appellants submitted that thereafter the office of the Chief Legal Advisor, Mumbai appointed panel Advocate and Papers were forwarded to the Advocate to file the Appeal. The Applicants/Appellants submit that, upon perusing the papers the Advocate requested for the some more papers. The Applicants/Appellants submit that thereafter Advocate intimated to the Appellants regarding the requirement of payment of the amount at the time of filing Appeal. The Applicants submit that thereafter the Appeal is filed as expeditiously as possible. The Applicants/Appellants submit that for the aforesaid genuine reason there is delay in filing the Appeal. The Applicants /Appellants are Company and therefore it was necessary to obtain the permission and follow the procedure. The Applicants/Appellants submit the delay is circumstantial and occurred on account of aforesaid genuine reasons and the said delay is not deliberate and intentional.
7. The Appellants/Applicants further submitted that, in the circumstances aforesaid, the reliefs as prayed for by the Appellant herein be granted. The Applica
