HON’BLE MR. NITYASUNDAR TRIVEDI, MEMBER Being aggrieved by and dissatisfied with the Judgment dated 02.12.2019 passed by Ld. DCDRC, Kolkata Unit—I in connection with complaint case No. CC/60/2019 which was dismissed against the OP Nos.1 and 2 (Insurance Company) on contest and ex parte against the OP No. 3/Heritage Health TPA Pvt. Ltd., the Appellant of this Case (who was Complainant in the District Level Case) preferred this Appeal.
2. On verification of the papers submitted along with this Appeal prayer it is learnt Mr. Abhay Poddar was under the coverage of National Mediclaim Policy in the year 2018 from the NIC Limited (he being junior, represented by his father and natural guardian, Mr. Vivek Poddar). The Mediclaim Policy was valid for 07.05.2018 to 06.05.2019 for which the guardian of the junior Complainant had to pay Rs. 12,958 /- (him being junior, represented by his father and natural guardian, Mr. Vivek Poddar).
3. It is stated by the Complainant that the OP No. 1 and OP No. 2 when approached by the Complainant for reimbursement of Rs.1,48,891/- for being treated in Woodland Hospital for treatment of a serious ailment on 03.11.2018, the OPs repudiated his claim on the
