670 591 ORDER HON’BLE JUSTICE SRI. B. SUDHEENDRA KUMAR : PRESIDENT This is an application praying for transferring C.C.No.183/2021 on the files of the District Consumer Disputes Redressal Commission, Kasaragod (for short, ‘the District Commission’) to any other District Commission.

3. Heard the learned counsel for the petitioners. Perused the remarks submitted by the President of the District Commission concerned.

4. It is contended by the petitioners that the present President of the District Commission was the erstwhile President of Chengala Agricultural Welfare Co-

st operative Society and during the said period, the 1 complainant had filed a complaint against the Chengala Agricultural Welfare Co-operative Society in connection with the irregularities and malpractices committed by the society. In view of the above, the complainants have requested for transferring the above complaint from the District Commission, Kasaragod to any other District Commission.

Having gone through the reasons stated by the petitioners, in the light of the remarks submitted by the President of the District Commission, Kasaragod, we are satisfied that it is only just and proper to transfer C.C.No.183/2021 pending before the District Commission Kasaragod to some other commission for trial and disposal in accordance with law. The District Commission, Kannur is the nearest District Commission. In the said circumstances, we are inclined to transfer the above said complaint to the District Commission, Kannur.

In the result, this application stands allowed and C.C.No.183/2021 on the files of the District Commission, Kasaragod stands transferred to the District Commission, Kannur for trial and disposal in accordance with law. The District Commission, Kasaragod is directed to transmit the records relating to C.C.No.183/2021 forthwith to the District Commission, Kannur with due notice to the parties. The District Commission, Kannur shall take the complaint into its files, re-number the complaint and proceed with the complaint in accordance with law. Needless to state that the District Commission, Kannur shall issue notice to the parties, before proceeding with the complaint.
