These two appeals are filed U/s tS of the Consumer Protection Act, 1986 (in short Cp Act). A/49/20t6 is filed by the complainant seeking enhancement of compensation. A/142/2016 is filed by Opposite party (in short OP) chailenging the order dated

29.t2.2OLs passed in CCl1446/20t4 on the file of District Consumer Disputes Redressal Commission, Mysuru (in short the District Commission).

The Rank of the parties shall be referred to as per their status before the District Commission.

3. The Brief facts of the case are that;

complainant is the Chartered Accountant by profession located at Mysuru. He is the valuable customer of the OP. He has obtained a international credit card bearing No.4862930100553004 having credit timit of Rs.5,00,000/-.

The complainant has never visited to any foreign country nor used the credit card for any other purpose outside India. on 21.11.2013, he has received the statement relating to his credit card and he came to know that there was a transaction took place for morethan Rs.6,00,000/- at USA between 11.11.2013 to

13.11.2013.

Comptainant has approached the Op and lodged a complaint and later on 15.05.2014 Op has reversed a sum of Rs.96,1g6/_ only. On 11.0g.2014 a sum of Rs.4,95,000/- was reversed being claimed by the insurance company. Op has demanded a sum of Rs.62,723/-.

The Op also shared the personal details of the complainant with CIBIL wherein the complainant has been block listed and the loan supplied by the other financial institution came to be rejected. Hence pleadin s deficiency of service, complainant has filed the complaint before the District Commission.

Before the District Commission, Op put their appearance through learned advocate and filed version opposing the claim of the complainant contending that the card was used and the complainant has shared the secret code provided to the card holder. The complainant is required to surrender the card immediately after visiting the foreign countries. But the card was not surrendered.

The comprainant has craimed the cash back amount from the insurance company and hence a sum of Rs.96,196.65/- on Zg.O3.2Ol4, Rs.4,95,000/_

on

22.07.2074.

Thereby Rs.5,91,186.65/_

was credited to the account of the comprainant.

The op is not riabre to pay any amount claimed by the complainant.

As per the Rules, CIBIL report was submitted. There is no deficiency on their part and sought for dismissal of the complaint.

Before the District Commission, affidavit evidence of complainant and also the Senior Manager of the OP was filed. The District Commission after hearing both the parties, allowed the complaint in part and directed the OP to reverse Rs.62,723/- otherwise, to pay the said amount with interest @ 18% p.a. and also awarded compensation of Rs.25,000/- and litigation cost of Rs.2,000/-.
