Delay of 127 days in filing of present appeal stands condoned for the reasons mentioned in application seeking condonation of delay.

2. In present appeal No.200 of 2023; legality of order dated 08.09.2022 passed by learned District Consumer Disputes Redressal Forum, Yamuna Nagar at Jagadhri (In short “District Consumer Commission”) in complaint case No.285 of

2022 has been assailed; vide which complainant’s complaint has been allowed.

3. The brief facts of the case are that an electricity connection is standing in the name of Permehswari Devi grandmother of complainant. After the death of his grandmother and his father, he and other legal heirs of his father Ascharag Lal Sharma became co-sharers in the house and they all started residing separately.

His brother Rakesh Kumar with a malafide intention disconnected the electricity supply, which was in the name of his grandmother Permeshwari Devi (since deceased). He applied for separate electricity connection to his portion of the house vide application dated 19.05.2022, but his application was rejected by OPs with the observation that your application is incomplete due to requirement of current house tax assessment, NOC of Rakesh, Neelam and Manjit. Complainant is owner in possession of his share in the house and NOC from other co-sharer is not required to take electricity connection.

Upon notice, OP raised its contest and admitted the filing of application for domestic electricity connection by the complainant in the house and also admitted the rejection of his application on the ground that the house has not been partitioned by mates and bounds and for release of electricity connection in the house, No Objection Certificate from other co-sharer, who have been recorded in the assessment register is required, in terms and conditions of Sale Circular No. U- 02/2020. Complainant has filed the complaint with mala fide intention in collusion with other co-sharers just to avoid their liability from paying arrears of dues of Rs.45,377/- till date due against the previous connection bearing account No.6401380000, which was being used by the complainant and other co-sharers and thus applied for fresh electricity connection.

5. Parties led their respective evidence. On analyzing the same; learned District Consumer Commission, Yamuna Nagar at Jagadhri has allowed complaint vide impugned order dated 08.09.2022, which is as under:-

“Hence, due to reasons stated here-in-before, the complaint is accepted against the opponents, holding the opponents jointly and severally liable to release the domestic electricity connection in favour of the complainant within the period of one month from the date of completion of necessary formalities by the complainant, such as submission of fresh application, deposit of security and another expenditure as per rules of the UHBVNL and also to make payment of punitive damages in the sum of Rs.5000
