Samiksha Bhattacharya, Member The instant case has been filed by the complainant u/s 12 read with Section 17 of C.P. Act, 1986 against the OP Nos.1 & 2 alleging deficiency in service and also impleading the other co-owners of the property in question as Proforma Opposite Parties as OP Nos. 3 to 18.

Facts of the case, in brief, are that the OP No.1 is the Proprietor of Developing Firm/OP No.2 and the OPs No.3 to 18 are the other landowners of the property in question. Previously the said property measuring an areas about 7 cottahs and 8 chittaksalongwith structure standing thereon appertaining to 13 was known an Touzi No.6, 63, 1510, R.S. Khatian No.126, C.S.
