1. Under challenge in this appeal is impugned judgment and order dated 10-07-2014 passed learned District Consumer Commission First, Lucknow in Complaint Case No. 640 of 2011; Sri Kris Kumar Varma Vs Regional Passport Officer whereby the complaint was allowed and following order passed against the appellant herein.

The complaint is partly allowed. The OP is directed to pay Rs.50,000.00 (Rupees Fifty Thousand only) as compensation and Rs.2,500.00 (Rupees Two Thousand Five Hundred only) as cost of the litigation. The compliance of the order is to be made within a month. If the payment of amount of compensation is not made within a month then the OP shall pay 9% interest on the above amount till the final payment is made.
A copy of the judgment is to be sent to the Secretary, Ministry of External Affairs, Govt. of India for finding out the responsible Officer/officials in the matter for the inordinate delay caused in the issuance of the passport to the Complainant and ”
then recover the compensation amount from the concerned officer/officials.
2. Relevant facts for the purpose of this appeal are that the complainant/respondent applied on 13-
2009 for issuance of general passport from the Regional Passport Officer while he was posted as Se Manager (finance and accounts) in HAL, Korwan Amethi, District Sultanpur. He had given permanent address as House No. 55-B, Tulsi Vihar, Sector-14, Power House, Indira Nagar, Ghazipur, District-Lucknow. His present address was shown as Quarter No.C-145, HAL Hindu Aeronautics Limited, Korwan Amethi, Sultanpur. The complainant/respondent had also enclosed NOC issued by his employer. At the time of verification by the LIU, he was residing at HAL, Kor Amethi, Sultanpur with his wife, therefore, the LIU reported that the complainant/respondent is residing at his given permanent address. On 27-12-2010, the complainant/respondent wrote a l to the Regional Passport Officer for issuing the passport immediately bringing to his notice negligence of his office but to no avail. It is stated by the complainant/respondent that the oppo party/ appellant should have sent to the SP or LIU concerned for inspection at present addres Sultanpur of the complainant/ respondent for the verification of the form. However, the informa was not sent to S.P. Sultanpur and LIU, hence the verification of the address of complainant/respondent could not be done which resulted in not issuance of the Passport.
3. It appears that the passport was required by the complainant/respondent because his daughter Rashmi Srivastava was residing in UK for the last 08 years and was not keeping well for the las years, therefore, the complainant/respondent and his family wanted to visit her in order to look their daughter.
