1. Being aggrieved and dissatisfied with the order passed by the Ld.District Consumer Commission, Raigad at Alibag in consumer complaint no.CC/15/166 dated 31/01/2017, the original complainant as well as opponent have preferred these appeals challenging the impugned order. Hence, both the appeals are taken up for hearing together and are decided by this common order. The parties to these appeals shall be herein after called and referred to as per their status in the original consumer complaint.
2. The complainant is a Medical Practitioner. On 22/11/2007, he along with his wife were travelling by “Ahimsa Express” from Dahanu station to Pune. The complainant had booked his ticket for 3 Tier sleeper class. The complainant had to attend the marriage function of his Niece, therefore, he was travelling to Pune by Railway. He boarded the train at Dahanu Railway station. The train was halted at Bhiwandi railway station for one and half hour due to Mega Block. It was contended that during the travelling between Vasai & Bhiwandi station, there was no TTE and Security staff. Similarly, many travellers were boarding the train without proper reservation. The RPF Staff was also not available in the train. The complainant and his wife felt insecure during the night time as the doors of the compartment were open. It was contended that at about 3.10 a.m. to 3.15 a.m. while train reached the Karjat Railway station, the wife of the complainant felt sleepy. During the said time, some unknown person snatched the purse from the possession of wife of the complainant and ran away. The said purse was containing cash of Rs.15,000/- Mobile Phone, Driving License, Specs, Credit Card, gold ornaments and keys of the complainant’s hospital worth totalling an amount of Rs.5,82,500/-. As the wife of the complainant lost the purse, she started searching. Unfortunately, no Security Guard was available. In the meantime, train started to move. The complainant pulled the chain. The Station Superintendent visited the compartment of the complainant to whom the complainant narrated the incident but the said Superintendent showed his incompetency to help the complainant and signaled the train to proceed ahead. The complainant again pulled the chain and stopped the train and informed that his complaint should be recorded. It was contended that RPF Officer from Karjat Station and a Constable came to the complainant and informed him to visit the RPF police station to lodge the complaint. The complainant told that he is unable to leave the luggage which were locked with the chain and the keys were lost along with the purse. The TTE came along with the constable, the complainant lodged the FIR and advised to show the copy at the Pune station RPF. Accordingly, after reaching Pune station, the complainant was advised by the Pune station RPF to lodge the complaint at Karjat. Accordingly, the complainant cancelled the marriage function
