WEDNESDAY, TWENTY SIXTH DAY OF MARCH, TWO THOUSAND TWENTY FIVE ORDER: (PERHON’BLE SMT. R.S. RAJESHREE, MEMBER, NON-JUDICIAL)

1. This is a complaint filed by the Complainants U/s. 17 of Consumer Protection Act,1986 on 17.03.2017 against the Opposite Party to direct him as follows:-

(i) To provide the present electricity and water supply uninterruptedly. (ii) To provide electricity power through individual meters. (iii) To operate the erected lifts immediately for easy commutation to 5th floor. (iv) To complete the flooring in the parking and allot the marked parking. (v) To pay interest on the entire sale consideration @18@ from the 16.05.2015 to till the completion of the project from the Opposite Parties. (vi) To direct the Opposite Parties to pay the interest paid by the Complainant to the financial institutions for his loan account. (vii) To direct to pay the Opposite Parties Rs.3,60,000/- towards damages. (viii) To direct the Opposite Parties to pay Rs.1,50,000/- as compensation towards mental agony suffered by the Complainant and her family members. (ix) To complete the leftover works immediately, and pass such other order or orders as this Hon’ble State Commission may deem fit and proper in the circumstances of the case.

2. Brief facts of the case: The case of the Complainant is that the Accountant’s General Office Co-operating Housing Society limited has undertaken a project for construction of apartments for their members under the name and style Sri Mahalakshmi residency 14th venture situated at survey NO.64/P, 65/P of Hyderguda Village, in Sy. NO.64/P, 65/P, 66/P, 121/P, 122/P, 124/P, 125/P and 126/P of Upperpalli Village, Rajendra Nagar Mandal, Rangareddy District. As some of the flats were not booked by the members, the society offered the same to outsiders and also released a brochure explaining the salient features of the project. The Complainant being lured by the amenities being provided, had decided to purchase a flat in the project being developed by the Opposite Party by blindly believing the promises of Opposite Party & considering their reputation that it is the society formed by AG’s office and hoping to get a quality construction. The Opposite Party also promised to provide the common amenities.

Being attracted by the amenities and the fact that the Opposite Party had already obtained the building permit vide proceedings No.16953/HC/SZ/Cir-6/SZ2012, dated 19.11.12, they proceeded with purchase by paying an advance of Rs. 5,78,080/- by way of cash for
