26.03.2025 and, after hearing the arguments of the counsel for the complainant and the opposite party and on perusing the materials on record, this Commission passes the following:-

O R D E R

R.SUBBIAH, J-PRESIDENT This complaint has been filed under Section 17 of the Consumer Protection Act, 1986, as against the Opposite Party for the following reliefs:

i) To direct the opposite party to pay a sum of Rs.2,00,000/- towards loss of rental income to be availed out of the flat to the complainant;

ii) to pay a sum of Rs.8,00,000/- towards monetary loss, hardship, mental agony, trauma, stress physical strain, pain, pressure caused to the complainant;

iii)to pay a sum of Rs.6,00,000/- towards compensation payable by the complainant to his vendor;

iv)to pay a sum of Rs.1,47,200/- towards the interest paid to financier for the amount of Rs.2,30,000/- @ 4% interest borrowed by the complainant for the closure of his personal loan for the period between August 2015 to November 2016 and also further future interest until the disposal of the present complaint;

v) to pay a sum of Rs.2,78,512/- towards the EMI's paid by the complainant between October 2015 to October 2016 for the loan availed by the complainant for the purchase of the Flat and also further payments until the disposal of the present complaint;

vi)to refund a sum of Rs.1,62,500/- towards the house rental and maintenance for the present house Rs.12,500/- per month from October 2015 till October 2016 and also the rentals until the disposal of the present complaint; and vii)to pay costs of the complaint.

2. The case of the complainant is that, the opposite party is a leading global Private Sector based Banking Company. The complainant has been maintaining Savings Bank Account bearing No.5205306449, with the opposite party bank for the past 5 years before filing the complaint. He had taken several personal loans from the opposite party bank and closed the same within the stipulated time as per the terms and conditions of the opposite party bank. While so, in the year 2014, the complainant had availed a personal loan bearing A/c No. L2SACH7317217 for an amount of Rs.3,00,000/- from the opposite party bank. The complainant had been regular in paying the monthly installments towards the said loan as and when the same falls due, without any default. While so, in the year 2015, the complainant had made a plan to buy a flat at Madipakkam as a surprise gift for his wife on the eve of their 2^nd Wedding Anniversary which falls on 9^th September 2015. The complainant had approached the HDFC Bank for availing the housing loan. The HDFC Bank agreed to sanction the housing loan provided the complainant clears all his previous loans including the personal loan availed from the opposite party bank.

(a) Hence, the complainant has made a requisition to the opposite party bank over phone on 02.09.2015 to inform about the details of final payment and procedures connected therewith towards closure of the said loan. In response to the said requisition, the opposite party bank has sent a letter on 02.09.2015, informing that the complainant has to make a total outstanding payment of Rs.2,32,839/- including the interest. The complainant has already borrowed a sum of Rs.2,30,000/- @ 4% monthly interest from a private financier towards the repayment of the said loan. Subsequently on 03.09.2015, the complainant himself personally approached the
