JUDGMENT
HON’BLE JUSTICE SRI. B. SUDHEENDRA KUMAR : PRESIDENT The appellants are the opposite parties 3, 5 and 6 in C.C. No. 178/2015 on the files of the District Consumer Disputes Redressal Commission, Kottayam (for short, “the District Commission”).
2. The complainant was maintaining a savings bank account in Kottayam District Survey and Land Records Employees Co-operative Society Ltd. The complainant also joined a group deposit scheme and deposited various amounts under the said scheme as fixed deposit. The opposite parties are liable to pay a total amount of Rs. 2,10,981.75 (Rupees Two Lakh Ten Thousand Nine Hundred and Eighty One and Paise Seventy Five only) to the complainant. However, when demanded, the amount was not refunded by the opposite parties. In the said circumstances, the complainant filed the above complaint alleging deficiency in service on the part of the opposite parties. 3. The opposite parties 1 to 3 filed a joint version admitting the deposit made by the complainant. However, it was contended that the amount deposited by the complainant had been manipulated, forged and misappropriated by the former Secretary of the society and in the said circumstances, the cooperative society was not responsible for making pay
