1. This appeal is filed by the Appellants/Complainants No.1 and 2 Under Section-41 of Consumer Protection Act, 2019 praying this State Commission to allow the complaint and to set aside the impugned order of the District Forum-II, Hyderabad passed in CC. No. 136/2019 dt.03.06.2020 and consequently to allow the complaint as prayed for.

2. For the sake of convenience, the parties are referred to as arrayed in the complaint. The appellants herein were complainants and Respondents was the opposite parties in the complaint bearing No.CC 136/2019 before the District Forum-II Hyderabad.

3. The brief case of the complainant is as follows:-

The complainants are wife and husband. While they have been shopping at Big Bazaar, Hyderabad, on 25-01 2007, one person represented by opposite parties, distributed slips printed by opposite parties asking furnish details like address and phone numbers on the slip and wrap it and directed to put in the box. The said slips were filled in by the complainants and dropped the same in the opposite parties drop box. The complainants have received phone call from the opposite parties office on 27-01-2007 stating that they have received a gift in the lucky dip for vouchers as they dropped in the box on 25-01-2007.

One more phone call received on 30-01-2007 informing that they get gift in the competition of 1:50 and asked them to collect their gift at the office of opposite party in Hyderabad i.e., Hotel Amrutha Castle Best Western, opposite to Secretariat, Saifabad, Hyderabad. They went to Hyderabad on 31-01-2007 and visited the office of the opposite party.

The Marketing officer of the opposite party received them and explained gifts and complimentary benefits like vacations/Holidays, Country Club (India) Ltd, VLM Cards, and a plot admeasuring 150 Sq. yards in Golf Village where they are constructing Golf Club at Jangaon (95 Kms) Hyderabad, which is in the Highway of Hyderabad to Warangal (95 Kms). The Marketing Officer has explained the benefits like Holidays Club Cards, Plot of 150 Sq. yards in Golf Village. The complainants has to pay Rs.1, 00,000/- for membership benefits and Rs.15,000/- for registration and development charges for Post. The deposit amount should be payable in installments. The complainants attracted for the gifts and benefits which promises by them and paid initial installment payments @ Rs.40,000/-payable to the opposite party on 31-01-2007, for which a receipts was given having membership
