O R D E R
BY SMT. SUNITA C.BAGEWADI, MEMBER This appeal is filed by the Appellants/Opposite Parties being aggrieved by the order dated
04.08.2015 passed by the District Consumer Disputes Redressal Commission, Kolar in CC.No.11/2015 and prays to set-aside the order passed by the District Commission and dismiss the complaint, in the interest of justice and equity.
2. The facts of the case;
On 17.06.2014 the complainant had booked new ERTIGA VDI BSIV – R3RDCL Silky Silver Colour vehicle (Car) with Opposite Party No.1 and Opposite Party quoted the road cost of the vehicle of Rs.8,24,895/-. On 17.06.2014 the complainant had paid Rs.5,000/- towards advance booking and later he had paid Rs.50,000/- on 13.08.2014, Rs.7,76,595/- on 23.09.2014 and Rs.500/- on 15.10.2014 totally Opposite Party No.1 had received Rs.8,32,095/-. The complainant had obtained a delivery of the said vehicle on 15.10.2014. The Opposite Party No.1 had received the excess amount of Rs.7,200/- than that of the actual cost of the vehicle on road. Hence, complainant claimed for refund of the excess sum of Rs.7,200/-. Opposite Party No.1 issued a statement of Account dated 21.10.2014 adjusting the same by giving explanation that Rs.450/- came to be collected towards Temporary Registration and Rs.6,750/- towards handling Charges. Hence, the complaint.

After service of notice of the District Commission, the Opposite Parties No.1 & 2 appeared through their counsel and filed version and admitted that the complainant had paid sum of Rs.8,32,095/- towards purchase of the vehicle and they had issued the order booking form cum sales contract in which details regarding cost of the vehicle, insurance, handling charges etc., have been mentioned and prays for the dismissal of the complaint.
4. After trial the District Commission allowed the complaint.
5. Aggrieved by the said order the Appellant/ Opposite Parties preferred this Appeal.
6. Heard from Appellant side. Inspite of sufficient opportunities has been granted, respondent not present and not argued the matter.
