Newlin Frederick for R2 to 4 These appeals came up for final hearing on 25.07.2025 and upon hearing the arguments of the counsel for the appellant, counsel for the respondents as well as the respondent-Party in Person and on perusing the material records, this Commission made the following

R. SUBBIAH, J - President Both these appeals are filed as against the order dated 09.05.2024 made in C.C. No. 45 of 2023 on the file of the District Consumer Dispute Redressal Commission, Ariyalur
2. While F.A. No. 664 of 2024 is filed by the Opposite Parties 1 to 3 in C.C. No. 45 of 2023, the fourth Opposite Party in the very same Consumer Complaint has filed F.A. No. 1116 of 2024. The learned counsel on either side has advanced common arguments in both the appeals. Furthermore, the parties to these appeals are same in these appeals and the issues which arise for consideration are also common. Therefore, both the appeals are taken up for hearing together.
3. For the sake of convenience, the parties to this appeal shall be referred to as per their litigative status in the Consumer Complaint as “Complainant” and “Opposite Parties” as the case may be.
4. The Consumer Complaint No. 45 of 2023 was filed by the first respondent-complainant under Section 35 of the Consumer Protection Act, 2019. According to the complainant, he retired from Tamil Nadu Electricity Board as Class II Officer on 31.10.2005. It was stated that the complainant has already purchased a Maruti Car (Wagon R LXI) bearing Registration Number TN 61 3480 in his name for his own personal use and to cater to the needs of his aged parents who are residing along with him. As the vehicle he purchased before 14 years has become too old, in the year 2023, he booked a new Wagon R VX1-1.0 Silver, in exchange of his old car valued at Rs.2,00,000/- with the 4th Opposite Party. As per the booking order issued by the Fourth Opposite Party on 22.09.2023, the new Car was valued at Rs.7,19,320/
